Terms and Conditions for Domestic Assistance

The below Terms and Conditions for Domestic Assistance Services are a binding agreement between you as the Client and South Coast Nannies ABN 29 416 096 750 of Nowra in the State of New South Wales, hereinafter referred to as (SCN). Acceptance of Services is an immediate agreement regarding SCN Terms and Conditions.

Definitions

The Terms and Conditions below are a binding agreement between you as the ‘Client’ and South Coast Nannies ABN 29 416 096 750 of Nowra in the State of New South Wales (hereinafter referred to as (“SCN”). Acceptance of Services is an immediate agreement regarding SCN Terms and Conditions.

SCN refers to the company / South Coast Nannies.

Nannies refers to the person(s) employed by SCN.

Client refers to the person(s) or company that engages SCN to undertake Domestic Assistance services

Case Manager refers to person(s) or case worker who provides ongoing management of the Client and undertakes the assessment, monitoring, planning, advocacy and linking of the Client with rehabilitation and support service

Primary Carers refers to person(s) who are the primary Carer of the children (Parent/Guardian).

Domestic Assistance refers to the services not covered as a medical, hospital or rehabilitation expense as a result of Personal Injury & Accident Services Insurance Claims. Domestic Assistance is provided in the Client’s residence.

Obligations

SCN is responsible for providing a safe environment for Nannies when providing Domestic Assistance Services. SCN and its Nannies are required to comply with any legislation relating to Industrial Relations and SafeWork practices. SCN undertakes stringent recruitment processes to ensure that our Nannies have the relevant qualifications and expertise to support the needs of individual families.

Clients and the Case Manager and/or Primary Carers have a duty of care to work together to provide a safe environment for Nannies in the home and cooperate with SCN and Nannies to ensure safe work procedures and a safe work environment. Client are obligated to abide by relevant Commonwealth workplace laws are entitled to general workplace protections.

Confidentiality

All information and services provided to SCN are considered as private and confidential. SCN will liaise with the Case Manager and Client and will provide updates on the placements progression. SCN and its Nannies are Mandatory Reporters to the Department of Family and Community Services (FACS). Mandatory reporters are required by law to report any suspected child abuse and neglect incidences to relevant government authorities.

Insurances

With all Domestic Assistance Services our Nannies have full employee coverage including Public Liability Insurance and Workers Compensation Insurance and are paid in accordance with the Miscellaneous Award.

Estimates

Estimates for Domestic Assistance Services are reflective of the individual requirements detailed by the Client on the “Request an Estimate Form”. Families requiring Domestic Assistance Services must complete SCN’s Family Registration Form for care.

Fees

In order to confirm and secure Domestic Assistance Services provided by SCN, the Client will be required to pay a non-refundable Booking Fee. The balance of the Client’s Domestic Assistance Services invoice is due 6 weeks prior to the first date of Service. Failure to pay the invoice prior to the booking will jeopardise the booking.

After full payment has been made, no revised quotations or reductions in the Service Fee will be made for services not required. SCN has a No Refund Policy in the event of cancellation or services.

Any variations of hours will be in consultation with SCN and the Client within the scope of the service. Placements are often time dependant, and will be evaluated on a case by case basis. SCN will endeavor to be flexible with the rescheduling of services as reasonably practical.

If the Domestic Assistance Services exceeds the agreed booked hours, an adjustment invoice will be created for additional hours and the amount deducted from the Client or Corporate Credit Card details provided. Parents/Guardians are required to sign the Nannies Timesheet at the end of each day to verify the hours worked.

Security and Privacy

7.1. SCN respects the right to individuals’ Privacy, and that you have control in how your personal information is collected and used. All information entered on our forms will be treated as strictly confidential. Please refer to our “Privacy Policy” which complies with the Privacy Act 1988.

7.2. SCN follows the PCI Security Standards (PCI) and abides by its comprehensive standards and supporting materials to enhance payment card data security. PCI Security Standards are technical and operational requirements set by the PCI Security Standards Council (PCI SSC) to protect cardholder data.  SCN uses PCI Compliance with NAB Transact in all its transactions.

Cancellations

8.1. Cancellation of Booking (by the Client)

Cancellations made by the Client more than 4 weeks prior to the Domestic Assistance Services, will result in a full refund of the Service Fee, less the Booking Fee. Cancellations made within the 2-week period prior to the start date of the Domestic Assistance Services, will receive a refund of 50% of the Service Fee, less the Booking Fee. To exercise the right to cancel, the Client must inform SCN of the decision to cancel the Domestic Assistance Service Agreement in writing via email to office@southcoastnannies.com.au.

8.2. Cancellation of Booking (by SCN)

In the event that the Client breaches the terms of this Agreement, SCN is entitled to terminate the Domestic Assistance Service Agreement in writing to the Client via email.

8.3. Cancellation of Booking (by the Nanny)

If an incident, outside our control, affects the provision of our Services: SCN will contact the Client as soon as reasonably possible. The provision of the Domestic Assistance Services will be suspended for the duration of the incident outside our control. SCN will restart the Service once we have made alternative arrangements to resolve the situation. SCN will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under the Agreement that is caused by an incident outside our control.

Liability

Notwithstanding the terms of this Domestic Assistance Service Agreement, the Client acknowledges and agrees that SCN does not accept any liability for losses or damages arising from or during the provision of its Services to any person or item. SCN shall not, under any circumstances, accept responsibility for the personal belongings of the children and parents/guardians.

Disclaimer

Any claim or discrepancy resulting from or relating to this Domestic Assistance Service Agreement, or the breach thereof, shall be addressed directly by SCN, the Client and Legal Representatives.

SCN Reserves the right to review and adjust these Terms and Conditions without prior notice. Latest changes will be noted and updated on South Coast Nannies website.
